Welcome to the Jarrett House. These Terms and Conditions of Accommodation (these “Terms and Conditions” govern all stays and interactions between Mount Beulah Hotel, Inc. d/b/a Jarrett House, a North Carolina corporation (“Jarrett House”, “we”, “us”, or “our”) and its guests (“Guests”, “Guest”, or “you”). By completing a reservation or checking in, you agree to be bound by all provisions set forth herein. Please read these Terms and Conditions carefully prior to your stay.
1. SCOPE
These Terms and Conditions shall govern any accommodation agreements or any other related contracts entered into between the Jarrett House and Guests. Any matters not stipulated in the Terms and Conditions shall be governed by law and generally established customs.
Any usage guidelines or precautions (“Rules”) provided by the Jarrett House are hereby incorporated into and made part of these Terms and Conditions. Notwithstanding the foregoing, special rates, promotions, packages, group blocks, or events may have additional terms and conditions and may be governed by additional agreements or contracts.
2. HISTORIC PROPERTY ACKNOWLEDGMENT
The Jarrett House is a historic property with unique character, charm, and architectural features that reflect its age and heritage. Guests acknowledge that the Jarrett House is not a modern, newly constructed facility and that certain features may differ from those found in contemporary hotels. Due to the historic nature of the property: (a) guest rooms and common areas may have traditional locks and do not include in-room safes; (b) floors may be uneven; and (c) doorways, ceilings, and railings may be lower or narrower than modern buildings.
These characteristics are part of the Jarrett House’s historic ambiance and are intended to preserve its authentic character. Guests are encouraged to exercise reasonable care while on the premises and to use caution when navigating the property. By staying at the Jarrett House, Guests acknowledge and accept these conditions as part of the unique experience offered by a historic property.
3. RESERVATIONS AND BOOKING
a. Making a Reservation. Reservations may be made via the Jarrett House website, telephone, email, or authorized third-party booking platforms. A reservation is confirmed only upon receipt of a written confirmation number from the Jarrett House or booking platform. Guests must be at least 21 years of age to make a reservation and check in. Valid government-issued photo identification matching the Guest making the booking is required at check-in. Failure to present a valid government-issued photo identification matching the Guest name of the booking at check-in may result in the cancellation of any booking without refund. Room type availability is not guaranteed until a confirmed booking is received. The Jarrett House reserves the right to offer a room of equal or superior category in the event the booked room type is unavailable.
b. Rates & Payment. Published room rates are per room, per night, and are subject to applicable North Carolina taxes and fees unless otherwise stated. The Jarrett House accepts major credit cards (Visa, Mastercard, American Express, Discover), debit cards, and cash. Personal checks are not accepted. A valid credit card is required at check-in for all reservations, regardless of payment method. Quoted rates are subject to change without notice until a confirmed reservation is made.
c. Incidental Deposit. An incidental deposit may be applied to the Guest’s credit card at check-in. The amount varies by room category and season. The deposit will be released within 5–10 business days after check-out, less any outstanding charges for incidentals, damages, or policy. Guests are responsible for all charges incurred during their stay, including damages, missing items, and excessive cleaning
4. CHECK-IN & CHECK-OUT
a. Standard Times.
Check-In: 3:00 PM local time.
Check-Out: 11:00 AM local time.
b. Early Check-In & Late Check-Out. Early check-in and late check-out are available upon request and subject to availability. Additional charges may apply.
c. Check-In Requirements. All Guests must present a valid, government-issued photo identification (passport, national ID, or driver's license) at check-in. A credit card in the registered Guest’s name is required at check-in for room charges and incidentals. The Jarrett House reserves the right to refuse check-in to any Guest who cannot provide valid identification or acceptable payment.
5. CANCELLATION AND MODIFICATION
a. Standard Cancellation Policy.
- Cancellations made 48 hours or more prior to the scheduled arrival date (before 3:00PM local time): Full refund of prepaid amounts.
- Cancellations made within 48 hours of the scheduled arrival date: One (1) night's room charge will be assessed as a cancellation fee.
- No-show (failure to arrive without prior notification): Full reservation amount will be charged.
b. Non-Refundable Rates. Certain promotional, advance-purchase, or non-refundable rates are not eligible for cancellation or modification. These rates will be clearly identified at the time of booking. No refunds will be issued for early departures under non-refundable bookings.
c. Modifications. Reservation modifications (dates, room type, guest count) are subject to availability and may result in rate adjustments. Requests for early departure must be submitted at least 24 hours in advance. A one-night early departure fee may apply. Extension of stay is subject to room availability and may be subject to a rate change.
6. GUEST CONDUCT & RESPONSIBILITIES
a. General Conduct. Guests are expected to conduct themselves in a respectful and lawful manner at all times while on Jarrett House premises. The Jarrett House reserves the right to remove any guest who: (i) engages in disorderly, offensive, or threatening behavior toward staff or other guests; (ii) violates any applicable laws or regulations; (iii) creates a nuisance or disturbance affecting the comfort of other guests; and/or (iv) is found to be in material breach of any provision of these Terms and Conditions or any other applicable Jarrett House Rules. Removal for cause will result in forfeiture of any prepaid accommodation charges with no refund. A Guest who refuses to vacate upon request may be removed with the assistance of law enforcement pursuant to applicable North Carolina trespass statutes.
b. Noise & Quiet Hours. Quiet hours are in effect daily from 9:00PM to 8:00 AM. For the comfort of our guests, we ask that during these hours guests keep noise to a minimum. Televisions, music, and conversations must be kept at a volume that does not disturb neighboring rooms at any time. Repeated noise complaints may result in eviction without refund.
7. NATURE OF OCCUPANCY
a. Occupancy. Room occupancy must not exceed the maximum permitted by the room type as specified at the time of booking. Additional guests beyond the booked occupancy must be declared at check-in and may incur additional charges. Visitors are permitted but may not stay overnight without being registered as a guest. Commercial, political, or religious activities are not permitted on Jarrett House premises without prior written approval from Jarrett House management.
b. Transient Occupancy Only. The Guest’s right to occupy a hotel room is that of a transient guest only. These Terms and Conditions are a lodging contract for temporary accommodation and do not, under any circumstances, constitute or create: (i) a lease of real property under North Carolina General Statutes Chapter 42 (Landlord and Tenant); (ii) a tenancy at will, periodic tenancy, a month-to-month or week-to-week residential agreement, or any other possessory interest in real property; month-to-month or week-to-week residential rental agreement; or (iii) any interest, estate, or right in real property of any kind whatsoever.
c. Classification Under North Carolina Law. The Guest’s occupancy is governed exclusively by North Carolina’s innkeeper laws (N.C.G.S. § 72-1 through § 72-7.1), these Terms and Conditions, and any other Rules promulgated by the Jarrett House. Consistent with North Carolina law, these Terms and Conditions do not create a landlord-tenant relationship and any deposit or card hold at check-in is simply a hold to cover incidentals or damages and shall not be considered a security deposit.
d. Extended Stays. The parties expressly acknowledge that an extended stay, however long in duration, does not convert the Guest’s transient occupancy into a tenancy or lease. Each night of occupancy is a separate transient lodging transaction. Continuous occupancy does not give rise to a periodic tenancy or any presumption of a residential rental arrangement.
e. Use of Room. The Guest acknowledges and agrees that: (i) a Jarrett House guest room may not be used as a primary or permanent residence; (ii) the Guest shall not use the Jarrett House address as a legal domicile, mailing address for government purposes, or address for the establishment of any legal rights; and (iii) the Guest has no right to sublease, assign, or grant access to any room or portion thereof to any third party.
8. SMOKING & SUBSTANCE POLICY
a. Smoking. The Jarrett House is a 100% smoke-free property. Smoking (including cigarettes, cigars, pipes, e-cigarettes, and vaping devices) is strictly prohibited in all indoor areas, including guest rooms, corridors, lobbies, and restaurants. Designated outdoor smoking areas are available and clearly marked on Jarrett House grounds. Guests found to have smoked in a non-designated area will be charged a deep-cleaning fee of $300–$500, in addition to any applicable damages.
b. Substances. The possession, use, or distribution of illegal substances is strictly prohibited on Jarrett House premises and will be reported to law enforcement.
9. PETS & SERVICE ANIMALS
a. Generally. Pets and animals are not permitted on the property and within the Jarrett House.
b. Damage by Pets. Guests are fully responsible for any damage, excessive cleaning, or remediation required as a result of any animal brought onto the property. The Jarrett House reserves the right to charge Guest’s credit card on file for any such costs.
c. Service Animals. Certified service animals are exempt from pet fees and restrictions in accordance with applicable law.
10. RIGHT OF ENTRY
a. Generally. Jarrett House staff may enter guest rooms for (i) housekeeping or maintenance; (ii) to address safety or security concerns; (iii) in the event of an emergency; or (iv) when required by law.
b. Housekeeping. Housekeeping services are provided daily between 8:00 AM and 4:00 PM. Guests wishing to decline daily housekeeping may do so by placing the “Do Not Disturb” (DND) notice on the door. Special housekeeping requests (additional towels, toiletries, pillow types, etc.) may be directed to the front desk or housekeeping department at any time.
11. PROPERTY DAMAGE & GUEST LIABILITY
a. Damages. Guests are financially responsible for any damage to Jarrett House property, furnishings, fixtures, or equipment caused during their stay, whether by the registered Guest or any accompanying visitor. Damage assessments will be conducted after check-out. Charges for damage will be billed to the Guest’s credit card on file.
b. Charing Guest Credit Card. The Jarrett House reserves the right to charge the credit card on file in an amount that Jarrett House determines, in its sole discretion, sufficient to reimburse the Jarrett House for the costs incurred in repairing the damage caused or in replacing damaged items that could not be repaired.
c. Notice. When charging a credit card, the Jarrett House will make a reasonable effort to contact the registered Guest via mail, e-mail, or other means of contact provided by the registered Guest at the time of making reservations or upon registration and check-in, and advise the registered Guest of the amount of the charge and the reasons for the charge. If requested by registered Guest, the Jarrett House will provide an itemized statement of the specific damages and of each of the amounts charged to repair or replace damaged property.
d. Mitigation. The Jarrett House will make every reasonable effort to repair or otherwise rectify the damage internally prior to retaining outside services to make repairs or to determine if repairs are possible prior to replacement of the item.
e. Damage; Amounts. Notwithstanding the foregoing, the Jarret House advises Guests as follows regarding the costs of repair and replacement:
- The term “damage” includes, but is not limited to, any damage incurred to the Guest’s room, any other room, or the Jarrett House’s structure or property during the Guest’s stay, including and without limitation for all property damage, missing or damaged items, theft or removal of items (including towels, blankets, robes, artwork, and electronics), costs of cleaning for smoking in the room or Jarrett House premises, costs of cleaning any damaged areas, compensation paid to other guests as a result of exposure to noise or other actions relating to the damage or the causing of the damage, and removal of waste or debris left behind after check out or departure.
- The costs and expenses of repairing damage or replacing damaged, lost, or stolen items may also include an administrative charge for the time spent in procuring the services of third parties to perform repairs, or in obtaining and scheduling delivery of replacement items.
- Damages for items requiring replacement will be charged at the new replacement value, plus shipping and handling charges, if any.
f. Criminal Charges. The Jarrett House may, in its sole discretion, pursue criminal charges against a Guest where damages are deemed by Jarrett House to be extreme or to have posed a risk to the health or safety of other guests and hotel personnel, such as, for example, where the guest has tampered with fire detection systems or fire-fighting equipment.
g. Removal. The Jarrett House may, in its sole discretion, remove a Guest where damages are deemed by Jarrett House to be extreme.
h. Theft. The Jarrett House is not responsible for loss, theft, or damage to personal property.
12. AMENITIES & FACILITIES
a. Amenities. Amenities may vary by season and availability. The Jarrett House does not guarantee uninterrupted access to any amenity and may modify or suspend services as needed. Guest shall use the amenities, including any computer networks or Wi-Fi services, at their own risk.
b. Facilities. Jarrett House facilities are for the exclusive use of registered Jarrett House guests and their authorized visitors unless otherwise stated. Children under the age of 16 must be supervised by an adult in facility areas. Guests use all facilities at their own risk. The Jarrett House disclaims liability for any injury sustained during use of facilities, except where caused by its own negligence. The Jarrett House reserves the right to close or restrict access to any facility at any time for maintenance, safety, or operational reasons.
13. SOCIAL MEDIA
a. License to Use Guest Content. By tagging, referencing, or otherwise sharing content that identifies the Jarrett House (including use of the Jarrett House’s name, location tags, or social media handles), Guests grant the Jarrett House a non-exclusive, royalty-free, worldwide license to use, reproduce, repost, display, and publish such content, including photographs, videos, and testimonials, for promotional and marketing purposes, including on the Jarrett House’s website, social media, and other media channels, unless the Guest expressly requests otherwise in writing.
b. Testimonial Use. The Jarrett House may use comments, reviews, and testimonials provided by Guests for promotional purposes, provided that such use does not misrepresent the Guest’s experience.
c. Event Photography and Recording. From time to time, the Jarrett House may photograph or record events, common areas, or general guest experiences for marketing or operational purposes. By entering the Jarrett House premises, Guests consent to being included in such photographs or recordings, provided that no Guest will be individually identified by name without prior consent.
d. Guest Responsibility and Liability. Guests are responsible for ensuring that any content they create or share, including photographs or recordings taken on the property, does not infringe upon the privacy or rights of other guests, staff, or third parties. The Jarrett House shall not be responsible for any claims arising out of guest-created content or the unauthorized use or sharing of such content.
e. Removal Requests. Guests may request removal of specific content used by the Jarrett House by submitting a written request, and the Jarrett House will use reasonable efforts to comply.
14. PARKING
a. Parking. Valet and self-parking are available. Valet parking charges are separate from room rates and shall be charged at posted rates.
b. Damage or Theft. The Jarrett House is not responsible for any damage to, or theft from, vehicles parked on Jarrett House premises.
c. Unattended Vehicles. Vehicles may not be left on Jarrett House property after the Guest’s check-out date without prior arrangement. Unauthorized vehicles may be towed at the owner’s expense.
15. PRIVACY & DATA COLLECTION
a. Policy. The Jarrett House collects and processes personal data in accordance with applicable privacy laws and our Privacy Policy. By making a reservation, you consent to: (i) collection and processing of personal data for the purpose of fulfilling your reservation and stay; (ii) sharing of necessary data with third-party service providers (payment processors, booking platforms) as required; (iii) use of CCTV and/or security systems in public areas of the Jarrett House for safety and security purposes; and (iv) receipt of transactional emails related to your booking (confirmation, invoices, post-stay surveys).
b. Privacy Policy. Our Privacy Policy is incorporated herein by reference.
16. FIREARMS & WEAPONS.
a. Compliance with Law. Guests and visitors must comply with all applicable federal, state, and local laws regarding the possession, storage, and use of firearms and other weapons while on Jarrett House property.
b. Prohibited Conduct. The open display, brandishing, use, or discharge of any firearm or weapon anywhere on the Jarrett House property is strictly prohibited.
c. Secure Storage. Firearms, if permitted by applicable law, must be stored in a safe and secure manner at all times and must not be left unattended in public or common areas. The Jarrett House reserves the right to require Guests to remove or safely secure any firearm that presents a safety concern.
d. Jarrett House Property. The Jarrett House reserves the right, to the fullest extent permitted by law, to restrict or prohibit firearms and other weapons in certain areas of the property.
e. Liability. The Jarrett House shall not be responsible for the loss, theft, or damage of any firearms or weapons, and Guests assume all risks associated with bringing such items onto the property. Guests are responsible for any damage or injury resulting from their possession or use of a firearm or weapon.
f. Exceptions. Exceptions to this policy are limited to law enforcement officers and designated military personnel who are on duty and required to carry firearms.
7. FORCE MAJEURE
a. Generally. The Jarrett House shall not be liable for any failure to perform its obligations where such failure results from events beyond reasonable control, including but not limited to natural disasters, acts of government, pandemics, civil unrest, fire, flooding, power outages, or acts of terrorism. In such cases, the Jarrett House will endeavor to offer alternative dates or a credit of equal value.
18. LIMITATION OF LIABILITY
a. Generally. The Jarrett House shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of profits, loss of business, or loss of enjoyment, arising out of or related to a Guest’s stay or use of the Jarrett House’s property. Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited under applicable law. To the fullest extent permitted by applicable law, the total aggregate liability of the Jarrett House for any claims arising out of or related to a guest’s stay, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the guest for the stay giving rise to such claim. The Jarrett House shall not be responsible for loss, theft, or damage to guests’ personal property, including vehicles and contents therein, except to the extent caused by the gross negligence or willful misconduct of the Jarrett House. Guests agree to take reasonable precautions to safeguard their property and acknowledge that use of the premises is at their own risk, except as otherwise provided by law.
19. DISPUTE RESOLUTION
a. Good Faith Negotiations. Any dispute arising under these Terms and Conditions shall first be subject to good-faith negotiation between the parties.
b. Disputes. Any unresolved disputes shall be resolved by binding arbitration in accordance with applicable rules, or, if arbitration is not pursued, shall be subject to the exclusive jurisdiction of the courts of the appropriate jurisdiction.
20. MISCELLANEOUS PROVISIONS
a. Governing Law. These Terms and Conditions are governed by the laws of the State of North Carolina.
b. Amendment. The Jarrett House reserves the right to amend these Terms and Conditions at any time. The version of the Terms and Conditions in effect at the time of your stay shall govern.
c. Entire Agreement. These Terms and Conditions, together with the reservation confirmation and any Rules promulgated by the Jarrett House constitute the entire agreement and understanding between the Guest and the Jarrett House. Events and group bookings may be subject to additional agreements.
d. Severability. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
ACKNOWLEDGMENT OF TERMS
By completing a reservation or checking in at the Jarrett House, the Guest confirms that they have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
